Od tohoto data platí tato legislativa ES a ČR: - nařízení Rady (ES) č. 338/97 ze dne 9. prosince 1996 o ochraně druhů volně žijících živočichů a planě rostoucích rostlin regulováním obchodu s nimi, včetně dalších právních předpisů ES vydaných na jeho základě - nařízení Rady (EHS) č. 348/81 z 20. ledna 1981 o společných předpisech pro dovoz výrobků z velryb a ostatních kytovců - směrnice Rady 83/129/EHS ze dne 28. března 1983 o dovozu kůží z jistých tuleních mláďat a výrobků z nich odvozených do členských států (transponována zákonem č. 100/2004 Sb.) - nařízení Rady (EHS) č. 3254/91 ze dne 4. listopadu 1991 o zákazu používání nášlapných pastí ve Společenství a dovozu kožešin a zboží z určitých volně žijících živočichů ze zemí, kde jsou tito živočichové odchytáváni pomocí nášlapných pastí nebo jiných metod odchytu, které nesplňují mezinárodní normy humánního odchytu do pastí, včetně dalších právních předpisů ES vydaných na jeho základě - směrnice Rady 1999/22/ES ze dne 29. března 1999 o chovu volně žijících živočichů v zoologických zahradách (transponována zákonem č. 100/2004 Sb.) - směrnice Rady 79/409/EHS ze dne 2. dubna 1979 o ochraně volně žijících ptáků (transponována novelizovaným zákonem č. 114/1992 Sb.) - směrnice Rady 92/43/EHS ze dne 21. května 1992 o ochraně přírodních stanovišť, volně žijících živočichů a planě rostoucích rostlin (transponována novelizovaným zákonem č. 114/1992 Sb.) zákon č. 100/2004 Sb., o ochraně druhů volně žijících živočichů a planě rostoucích rostlin regulováním obchodu s nimi a dalších opatřeních k ochraně těchto druhů a o změně některých zákonů (zákon o obchodování s ohroženými druhy) - implementace nařízení Rady (ES) č. 338/97 (CITES) - implementace nařízení Rady (EHS) č. 348/81 (výrobky z kytovců) - transpozice směrnice Rady 83/129/EHS (kůže tuleňů) - implementace nařízení Rady (EHS) č. 3254/91 (nášlapné pasti a dovoz kožešin) - implementace Mezinárodní úmluvy o regulaci velrybářství vyhláška č. 227/2004 Sb., kterou se provádějí některá ustanovení zákona č. 100/2004 Sb., o ochraně druhů volně žijících živočichů a planě rostoucích rostlin regulováním obchodu s nimi a dalších opatřeních k ochraně těchto druhů a o změně některých zákonů (zákon o obchodování s ohroženými druhy) 12

DEVELOPMET OF CITES LEGISLATIO I THE CZECH REPUBLIC Jan. 16, 1992 Feb. 28, 1992 May 28, 1998 June 1, 1992 Aug. 13, 1992 Dec. 16, 1992 Jan. 1, 1993 April 14, 1993 April 1, 1997 April 21, 1997 July 1, 2002 Decision of the Federal Government., 31 on accession of Czechoslovakia (CSFR) to CITES. Depositing of the documents on accession of the CSFR to CITES in the Depository (Government of the Swiss Confederation). CITES came into force for the CSFR. CSFR was the 114th party to the Convention. Czech ational Council Act. 114/1992 Coll., on Protection of ature and the Landscape - implemented CITES in the period from April 30, 1997; - since April 30, 1997, when the CITES legislation came into force, the Act. 114/1992 has been still covering some aspects of the CITES (protection of native fauna and flora which are CITES specimens; proving of legal origin of all CITES specimens) - amended by the Act. 218/2004 Coll. to enable transposition of the Council directive 79/409/EEC of 2 April 1979 on the conservation of wild birds and the Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora Decree of the Ministry of the Environment. 395/1992 Coll., implementing some of the provisions of the Czech ational Council Act. 114/1992 Coll., on Protection of ature and the Landscape (amended by the Decree. 175/2006 Coll.) - list of domestic strictly protected flora and fauna, some of which are simultaneously protected by the Convention. Communication of the Federal Ministry of Foreign Affairs. 572/1992 Coll., on negotiation of the Convention on International Trade in Endangered Species of Wild Fauna and Flora - official notification of the accession of the CSFR to CITES and publication of the Czech text of the Convention. CITES came into force for the Czech Republic (uninterrupted membership following from CSFR). The Czech Republic became the 117th party to the Convention. The Czech Ambassador in Bern delivered a note to the Depository of the Convention (Government of the Swiss Confederation) on continuation of membership of the Czech Republic in CITES following the abolishing of CSFR, with retroactive validity to January 1, Act. 16/1997 Coll., on the conditions for importing and exporting endangered species of wild fauna and flora and on amendment of the Czech ational Council Act. 114/1992 Coll., on the protection of nature and the landscape, in the wording of later regulations - provided for implementation of CITES (together with Act. 114/1992 Coll.) in the period repealed by the Act. 100/2004 Coll. (since May 1, 2004) Decree of the Ministry of the Environment. 82/1997 Coll. implementing some of the provisions of the Act. 16/1997 Coll., on conditions for importing and exporting endangered species of wild fauna and flora and other measures for protection of these species and on amendment of the Czech ational Council Act. 114/1992 Coll., on the protection of nature and the landscape, in the wording of later regulations - regulation for implementation of Act. 16/1997 Coll. - list of protected fauna and flora according to the CITES CoP 9 - amended by Decree. 264/1998 Coll. - amended by Decree. 216/2001 Coll. - amended by Decree. 332/2003 Coll. - repealed by the Decree. 227/2004 Coll. 17 Additional comments Most of the stricter measures resulted in the implementation of the Council Regulation (EC) 338/97 (CITES) and other relevant EC legislation. The additional stricter measures implemented by the Czech Republic: (1) Most of species listed by the CITES which are indigenous for the Czech Republic are strictly protected by the Act. 114/1992 Coll., on Protection of ature and the Landscape. Taking from the wild, trade and possession are prohibited. Exceptions only under strict conditions, e.g. for bred-in-captivity animals or artificially propagated plants. (2) Live exotic specimens of selected species of mammals, birds and reptiles from Appendix I and II must be registered by the state authorities in accordance with the Section 23 of the Act. 100/2004 Coll. In 2007 there were 6 persons prosecuted and accused of the crime of unauthorized management of protected wild fauna and flora*. Four of them were sentenced for the crime of unauthorized management of protected wild fauna and flora, in two cases the court suspended the trial conditionally. In 2008 there were 6 persons prosecuted and accused of the crime of unauthorized management of protected wild fauna and flora*. For two persons the trial was suspended conditionally, for other four persons the court trials still run. *The crime of unauthorized management of protected wild fauna and flora concerns both nationally protected non-cites fauna and flora and the CITES-listed species. Unfortunately, we have no statistics on crime concerning the CITES-listed species only. 10 How were the confiscated specimens generally disposed of?
