CS 10.8.2013 Úřední věstník Evropské unie L 216/1 II (Nelegislativní akty) NAŘÍZENÍ NAŘÍZENÍ KOMISE (EU) č. 758/2013 ze dne 7. srpna 2013, kterým se opravuje příloha VI nařízení (ES) Evropského parlamentu a Rady č. 1272/2008 o klasifikaci, označování a balení látek a směsí (Text s významem pro EHP) EVROPSKÁ KOMISE, s ohledem na Smlouvu o fungování Evropské unie, (ES) č. 1488/94, směrnice Rady 76/769/EHS a směrnic Komise 91/155/EHS, 93/67/EHS, 93/105/ES a 2000/21/ES ( 3 ), s ohledem na nařízení Evropského parlamentu a Rady (ES) č. 1272/2008 ze dne 16. prosince 2008 o klasifikaci, označování a balení látek a směsí, o změně a zrušení směrnic 67/548/EHS a 1999/45/ES a o změně nařízení (ES) č. 1907/2006 ( 1 ), a zejména na článek 53 uvedeného nařízení, vzhledem k těmto důvodům: PŘIJALA TOTO NAŘÍZENÍ: Článek 1 V části 3 přílohy VI nařízení (ES) č. 1272/2008 se údaje v tabulce 3.1 ve znění přílohy I a II nařízení (ES) č. 790/2009, které odpovídají položkám uvedeným v příloze I tohoto nařízení, nahrazují položkami uvedenými v této příloze. (1) Kontrola zjistila chyby v přílohách I, II, IV a V nařízení Komise (ES) č. 790/2009 ze dne 10. srpna 2009, kterým se pro účely přizpůsobení vědeckotechnickému pokroku mění nařízení Evropského parlamentu a Rady (ES) č. 1272/2008 o klasifikaci, označování a balení látek a směsí ( 2 ). Tyto chyby by proto mělo být opraveny. Článek 2 V části 3 přílohy VI nařízení (ES) č. 1272/2008 se údaje v tabulce 3.2 ve znění přílohy IV a V nařízení (ES) č. 790/2009, které odpovídají položkám uvedeným v příloze II tohoto nařízení, nahrazují položkami uvedenými v této příloze. (2) Opravená harmonizovaná klasifikace a označení látek se použije ode dne vstupu tohoto nařízení v platnost. Od dodavatelů by se nemělo vyžadovat, aby znovu označovali a znovu balili látky a směsi, které již byly uvedeny na trh v souladu s nařízením (ES) č. 1272/2008 před vstupem v platnost tohoto nařízení. Dodavatelé by však měli mít možnost dobrovolně používat ustanovení tohoto nařízení pro látky a směsi, které již byly uvedeny na trh. Článek 3 Položky uvedené v příloze III tohoto nařízení se doplňují do tabulky 3.1 v části 3 přílohy VI nařízení (ES) č. 1272/2008. Článek 4 Položky uvedené v příloze IV tohoto nařízení se doplňují do tabulky 3.2 v části 3 přílohy VI nařízení (ES) č. 1272/2008. (3) Opatření tohoto nařízení jsou v souladu se stanoviskem výboru zřízeného článkem 133 nařízení Evropského parlamentu a Rady (ES) č. 1907/2006 ze dne 18. prosince 2006 o registraci, hodnocení, povolování a omezování chemických látek, o zřízení Evropské agentury pro chemické látky, o změně směrnice 1999/45/ES a o zrušení nařízení Rady (EHS) č. 793/93, nařízení Komise Článek 5 Od dodavatelů není požadováno, aby znovu označovali a znovu balili látky uvedené v přílohách k tomuto nařízení, ani látky nebo směsi, které je obsahují, které již byly uvedeny na trh v souladu s nařízením (ES) č. 1272/2008 před vstupem tohoto nařízení v platnost.
