From the practical perspective, the brochure format has been changed. The information sources were the Czech Film Centre, National Film Archive, MEDIA Desk CZ, European Audiovisual Observatory, Union of Film Distributors, Czech Anti-Piracy Union and Separate Department of Administration of State Funds of the Ministry of Culture. The Department of Media and Audiovision of the Ministry of Culture appreciates any and all comments on and new information for the 2007 Report. 1

155x235 pages mkcr en 17.7.2007 12:06 Stránka 2 INTRODUCTION In the middle of 2006 after the veto of the President of the Czech Republic, the Chamber of Deputies definitely rejected the governmental draft amendment to Act No. 241/1992 Coll., on the State Fund of the Czech Republic for Support and Development of the Czech Cinematography (hereinafter referred to as Fund ), which amendment was particularly to strengthen the Fund resources. At the International Film Festival in Karlovy Vary, the representatives of political parties and Prime Minister promised to provide an extraordinary contribution of the state to the Fund. Following the discussions with the political representatives, a Working Group was established at the Ministry of Culture of the Czech Republic, aimed at formulating theses to describe the film community's expectations of an optimum shape of the state support, institutional assurance and overall legal framework in the cinematography area, on the basis of which it would consequently be possible to draft a new cinematography law. The law should address all the areas of film making, film production, film institutions and film education. On 14 November 2006, the Film Council was established to associate 17 professional associations, 9 film festivals and 5 film institutions and schools. It aims at co-ordinating the preparation of the cinematography law and informing its members on progress of such work. In 2006, an amendment to Act No. 273/1993 Coll., on certain conditions of the production, dissemination and archiving of audiovisual works, was adopted. Commencing 1 January 2007, the amendment also imposes, among others, an obligation upon producers and distributors to forward File Sheets to the Ministry of Culture of the Czech Republic, which will maintain, apart from the database of businesses engaged in the audiovision, also files of audiovisual works. STATE SUPPORT FOR CINEMATOGRAPHY The cinematography area is regulated by Act No. 241/1992 Coll., on the State Fund of the Czech Republic for Support and Development of the Czech Cinematography, and Act No. 273/1993Sb., on certain conditions of production, dissemination and archiving of audiovisual works, on modifications and amendments to certain laws and some other regulations, as later amended. In the financial support area, the state support is realised through the State Fund of the Czech Republic for Support and Development of the Czech Cinematography and selection procedure for subsidy from the Ministry of Culture. In both the cases, individual subsidy areas are announced every year. Projects are assessed and potential supports are recommended by a panel of independent experts. In 2006, the total financial support from the state budget in the area of medias and audiovision reached the amount of 91,616,590 CZK. The state covers the membership fees in European organisations, such as Eurimages, European Audiovisual Observatory and MEDIA Programme. 155x235 pages mkcr en 17.7.2007 12:06 Stránka 6 STATE FUND OF THE CZECH REPUBLIC FOR SUPPORT AND DEVELOPMENT OF THE CZECH CINEMATOGRAPHY The State Fund of the Czech Republic for Support and Development of the Czech Cinematography (hereinafter referred to as the Fund ) is a tool of the public support of film making (screenplay writing, film production and distribution) and technical development and modernisation of cinemas. The Fund also participates in co-financing cinematography promotion projects, e.g. festivals, meetings, showcases abroad etc. The Fund was established pursuant to Act No. 241/1992 Coll., and is headed by the Minister of Culture. The body deciding on the method and amount of financial means drawn for individual projects is the Fund Board. At its meetings, the Fund Board complies with the Fund Act, Statute and Rules of Procedure. The Fund Board is elected by the Chamber of Deputies on the motion of the Minister of Culture, and has 13 members at the most, elected for three-year term of office. The main financial resources of the Fund are revenues from commercial utilisation of the films to which the Fund exercises producer's copyrights (i.e. films produced in the Film Studio Barrandov and Film Studio Gottwaldov or Zlín and put into distribution in the period between 1 January 1965 and 31 December 1991) and levies on surcharge to the cinema admission fee. In 2006, 172 applications for financial support in a total amount of 384,132,000 CZK (25 th and 26 th deadlines of applications) were filed. The Fund Board has decided to provide supports to 86 projects in a total amount of 112,114,000 CZK (24 th and 25 th deadline). Under Resolution No. 73, adopted by the Government of the Czech Republic on 17 January 1996, the Fund is an authority competent to handle Applications for Co-Production Statute under the European Convention on Cinematographic Co-Production, which was announced under No. 26/2000 Coll. In 2006, the Preliminary Co-Production Statute was awarded to 12 projects and after work completion, the Definite Co-Production Statute was awarded to 3 projects. 155x235 pages mkcr en 17.7.2007 12:06 Stránka 11 INTERNATIONAL ORGANISATIONS European Audiovisual Observatory The European Audiovisual Observatory (EAO), having its registered office in Strasbourg, was established in 1992 on the common initiative of the European Union countries. The EAO mission is to gather information on the European audiovisual industry, provide such information to experts in the audiovision area and thus to contribute to a greater transparency of this sector in Europe. The EAO monitors all the areas of the audiovisual industry, i.e. film, television, video/dvd and new media. With respect to each of these areas, it provides information on markets and statistics, legislation and financing of audiovisual work production. It monitors and analyses the audiovisual sector evolution in the member states. The EAO associates 36 European countries, including the European Commission. It is financed by direct contributions of the member states and revenues from sales of its products and services. The Czech Republic became the EAO member in 1994. Within the membership fee, which is paid by the Ministry of Culture of the Czech Republic every year and which amounted to 13,893 in 2006, the Czech professionals have available legal regulations of the European countries and directives of the Council of Europe, periodical and non-periodical expert press in three language mutations, regularly published Stastical Yearbook, IRIS monthly and its supplements. Received information is also provided by the EAO to other co-operating European institutions which deal with issues of the audiovisual industry, EU MEDIA Programme and EURIMAGES Fund. More detailed information is available at www.obs.coe.int Eurimages The Eurimages International Fund was established to provide financial supports to film co-productions realised in European countries, their distribution and cinema networks presenting such films. The supports are designed for feature, documentary and animated film projects with the minimum length of 70 minutes to be distributed in cinemas, to distributors presenting films with the Eurimages participation, and in the cinemas included in the Europe Cinemas network. At least 2 member states of the Fund must participate in any such co-production. Eurimages also supports (i) the distribution of European films beyond the borders of the country where the film has been produced, and (ii) cinemas. However, the supports for the distribution and cinemas only concern the states which are not members of the MEDIA Programme, (and therefore, this part of the Eurimages Fund supports was only open to the Czech Republic until the end of 2002). In 2006, the Fund had 32 members, the Czech Republic has been its member since 1994 and is represented by a national coordinator therein. The membership fee of the Czech Republic to the Fund amounted to 194,042 in 2006. In 2006, the Eurimages Fund supported two projects with Czech participation: feature film, titled Oko (Eye), directed by Miloš Kohout and being made in Czech-Slovak co-production of Magic Films (CZ) and Alef Film&Media Group (SK), and the first Czech-Irish- Slovak co-production - film, titled Lištičky (Foxes) and directed by Mira Forney. It was formed in 1991 and aims at increasing the competitiveness and circulation of European works in the international audiovisual market. The Programme support is designed for independent European companies in the audiovision area. It is implemented through direct financing of the development of audiovisual works and financial supports for companies and organisations engaged in the dissemination of such works - film distributors, festivals, markets and cinemas. Financial support, which may only be applied for based on regularly announced calls for application submissions, can be obtained by any company or organisation whose project meets the criteria set for granting any such support. The Czech Republic joined the MEDIA Programme on 30 July 2002. The membership fee of the Czech Republic to the MEDIA Programme has been covered from the state budget since 2004 as a part of the total membership contribution of the Czech Republic to the European Union. The Czech Republic has two representatives, delegated by the Ministry of Culture, in the Steering Committee of the MEDIA Programme. At the national level, the contact between the MEDIA Programme and audiovisual professionals is ensured by MEDIA Desk Czech Republic office, which is operated by Česká filmová komora, o. p. s. The NFA aims to gather, protect, make accessible, scientifically process and utilise audiovisual archival documents on the national film production, film art origination and development, life of the Czech nation and significant world events. From the film archiving standpoint, the NFA ranks among the ten oldest film archives in the world (founded in 1943) and is the third film archive with the greatest increases of film materials. It has managed to save and preserve the greatest part of the national film heritage, more specifically, more than 60% of silent movies and 99% of sound feature recordings, which does not have any analogy in the world. As per the Foundation Deed, its core activities are as follows: a) collecting, protecting, processing scientifically and utilising audiovisual (film and video) materials and written archival materials; b) collecting and processing scientifically the heritage of significant personalities of the Czech cinematography; c) creating the collection of current documentations related to the production and dissemination of audiovisual archival materials and making it accessible; d) administering a special library; e) carrying out scientific research in the areas of film and film archiving; f) co-operating with domestic and foreign institutions in creating and disseminating the film culture, selling and lending audiovisual materials; g) co-operating with member archives of FIAF (Fédération des archives du film); h) co-operating with the Czech Federation of Film Clubs; i) carrying out publishing activities in the film culture area, selling periodical press; j) making documentary film recordings.. The National Film Archive also runs the Ponrepo Cinema, viewing room, which is located in BIO KONVIKT, a historically valuable refectory of the Convict, reconstructed in the 1990s. Admission is reserved for the Ponrepo Club members, and the annual membership card can be received in the cinema box-office. Selected performances are also accessible without any membership card. The National Film Archive exercises rights of the producer of Czech audiovisual works put into distribution between 1 January 1950 and 31 December 1964. Its office was opened in September 2002 and its main aim is to make visible and systematically promote Czech films abroad. From 2002, the Czech Film Centre's activities were financed from the APA resources, through the grant of the State Fund of the Czech Republic for Support and Development of the Czech Cinematography and selection procedure for subsidy of the Department of Media and Audiovision of the Ministry of Culture. In the same year, the Czech Film Centre became a member of the European Film Promotion, an international organisation. On 1 January 2004, the Czech Film Centre was transferred to Česká filmová komora o.p.s. (Czech Film Chamber), an allowance organisation. Since 2006, the Czech Film Centre has been financed from the financial resources of the Ministry of Culture and sponsors. Its activities are structured in two directions: FILM PROMOTION, ensuring the promotion of Czech films, and CZECH FILM COMMISSION, focused on services to the foreign production. The FILM PROMOTION co-operates with significant European festivals and markets, such as Berlinale and Cannes. It publishes a number of information materials, regular bilingual Catalogue of Czech Films, DVDs with film trailers and interviews with film makers, and there are also publications on feature and documentary films in progress. It regularly publishes its newsletter in English. Its website contains information on Czech films of the last years and other up-to-date activities of the Centre, e.g. seminars and presentations of Czech films abroad. Within the FINAL Plzeň film festival, the FILM PROMOTION presents feature films in progress every year, where the film projects are introduced to both Czech and foreign film professionals. In 2005, the Czech Film Centre, Documentary Film Festival and International Documentary Film Festival Jihlava decided to present documentary films separately in order to ensure a peculiar room which such films deserve. The presentation of documentary films in progress takes place in Prague in September. The establishment of the CZECH FILM COMMISSION in January 2004 arose from an increasing demand for the source of information for foreign film makers, as well as from the need to solve issues concerning the Czech Republic as the place where films are being shot for the foreign production. The CZECH FILM COMMISSION creates centralised networks of contacts and information on all aspects of the film production in the Czech Republic. In 2005, it published its Production Guide with information on the film industry, film shooting locations and conditions in the Czech Republic. The CZECH FILM COMMISSION aims at connecting the Czech film professionals with foreign producers and film makers, presenting high quality of the infrastructure and services, offered by the Czech film industry, providing relevant information on production services, facilities and conditions of the film production in the Czech Republic, presenting unique locations in the Czech Republic and communicating with the governmental and self-governmental institutions and informing them on the evolution and potential needs of the film sector.
